Family Files Lawsuit After Funeral Homes Mishandle Son’s Remains in Disturbing Chain of Events

In a devastating and surreal turn of events, the grieving parents of Timothy Garlington—a U.S. Marine Corps veteran—are suing two funeral homes after they were handed an unmarked, leaking box that contained their deceased son’s brain. The emotional trauma, the family claims, is irreversible.

What began as a solemn effort to honor their son’s life ended in a nightmare no parent should ever endure. The incident has sparked a high-profile legal battle and a broader conversation about accountability and ethics in the funeral care industry.


A Routine Transfer Turns Into a Horrific Discovery

 The Box That Smelled Like Death

After Garlington passed away in Georgia in 2023, his remains were scheduled to be transported to his family in Pennsylvania. The Butlers, his parents, had arranged for the body to be sent from Southern Cremations & Funerals at Cheatham Hill (Georgia) to Nix & Nix Funeral Home (Pennsylvania).

Along with the remains came a white cardboard box containing an unlabeled red box, which was handed over to the family as part of his belongings. According to their attorney, L. Chris Stewart, the Butlers were given no explanation about the contents inside.

When Abbey Butler attempted to open the red box, she was unable to do so. Days later, as the box sat in the family’s car, it began to leak a foul-smelling fluid. Her husband, Lawrence Butler, picked it up—only to find the substance on his hands.

“It was brain matter. It’s insane,” Stewart said during a press conference.

“It’s still in my heart that I got in my car and smelled death,” Lawrence Butler recalled, his voice breaking.


Lawsuit Seeks Accountability

The Butlers have filed an updated lawsuit alleging gross negligence, intentional infliction of emotional distress, and improper handling of human remains against both funeral homes.

Attorney Stewart emphasized that at no point in standard procedures is it acceptable for a human brain to be separated, shipped without documentation, or handed off in an unmarked box.

“There’s zero excuse for this type of error,” Stewart said. “No sealed biohazard bag, no labeling, no inventory list—nothing.”

According to Stewart, the Georgia funeral home acknowledged that the box contained Garlington’s brain but labeled it as a “mistake.” The Pennsylvania funeral home allegedly failed to verify the box’s contents or cross-check it with the list of personal effects.


Industry Standards Violated?

The funeral homes have offered conflicting responses. Julian Nix, manager of Nix & Nix, claims his staff thought the box held personal items, since no special markings indicated otherwise. He maintains the Georgia facility is to blame for sending the box.

Nix also said that when his team discovered the contents, they immediately contacted authorities and were cleared by the state board overseeing funeral homes. However, no documentation has yet been provided to verify that claim.

Southern Cremations’ parent company, ASV Partners, has declined to comment.

Stewart maintains that even if the Pennsylvania home did not know what was inside, they should have exercised due diligence. “You don’t just hand over an unmarked box that’s not on the manifest,” he said.


Lasting Emotional Damage

A Family’s Trauma That Won’t Fade

For the Butlers, the consequences are not just legal—they are deeply personal. Lawrence Butler said he had to get rid of the car in which the leaking box had sat.

“I just couldn’t stand the idea that the remains were in that car.”

Adding to their grief is the uncertainty: The family still doesn’t know whether Garlington’s brain was buried with his body, which is now interred at Washington Crossing National Cemetery.

Stewart noted that the Butlers never received an apology from either funeral home. Their lawsuit aims not only to hold the institutions accountable but also to prevent such a grotesque mishandling from ever happening again.


Who Was Timothy Garlington?

A Life Remembered, A Legacy Disrespected

Timothy Garlington was a 56-year-old Marine veteran who had moved on to work in higher education financial aid in Atlanta, according to his LinkedIn profile. Described by his father as a “good young man,” his service to the country makes the treatment of his remains even more appalling to his family.

“This is how a veteran is treated?” asked one relative during the press briefing. “It’s a national disgrace.”

While the cause of Garlington’s death has not been disclosed, what’s clear is that the postmortem treatment violated both ethical norms and industry practices.


Broken Systems, Broken Hearts

The Butlers’ story is horrifying, heartbreaking—and unfortunately, possible in an industry where oversight can sometimes be as fragile as the grief of the families it serves. Their legal battle is more than just about compensation—it’s about dignity, accountability, and justice for their son.

The lack of apology, the mishandling of biohazardous material, and the absence of safeguards reveal a gaping hole in the chain of custody for human remains. It’s a wake-up call for regulators and funeral service providers alike.

“The parents’ last memory is holding their son’s brain,” said Stewart. “That’s not just negligence. That’s inhuman.”
